The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on February 7, 2006 with the following members present: Edwin H. Humphrey, Ken Tracy and Mary Makley Wolff.
MR. TRACY made a motion to adopt the following Resolution:
RESOLUTION AUTHORIZING THE PETITION FOR SPECIAL ASSESSMENT FOR THE PURPOSE OF WATER SUPPLY FACILITIES, DISPENSING WITH THE SECOND READING
WHEREAS, the Miami Township Board of Trustees ("Board"), pursuant to Section 504.18 and 504.20 of the Ohio Revised Code, may levy special assessments upon lots and lands in the township benefiting from water supply facilities; and
WHEREAS, the Board may adopt, amend, rescind, publish, administer, and enforce rules for the construction, maintenance, operation, protection, and use of water supply facilities and sewer services, that are considered necessary and advisable. The rules shall not be inconsistent with the laws of the state or the rules of the environmental protection agency. The board may enforce the rules by mandamus, injunction, or other legal remedy; and
WHEREAS, residents in the Branch Hill area of Miami Township have expressed interest in petitioning the Board for the installation of water supply facilities; and
WHEREAS, the Township Administrator has conducted a preliminary evaluation of the feasibility of extending the existing water supply facilities to the residents in Branch Hill and has determined that the existing water supply can be extended.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees ("Board")
of Miami Township, Clermont County, Ohio, by authority of Chapter 504 of the
Ohio Revised Code, as follows:
SECTION 1: That the Township Administrator is hereby authorized to initiate
proceedings to prepare and submit for signatures a petition for special
assessment for the purpose of water supply facilities for the effected
properties in Branch Hill.
SECTION 2: That once a majority of signatures are obtained on the petition, the Township Administrator shall submit the petition to the Board who will act upon the petition and proceed according to the provisions of Section 504.18 and 504.20 of the Ohio Revised Code.
SECTION 3: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.
SECTION 4: That this Board hereby finds and determines that all formal
actions relative to the passage of this Resolution were taken in an open meeting
of this Board, and that all deliberations of this Board and of its Committees,
if any, which resulted in formal action, were taken in meetings open to the
public, in full compliance with applicable legal requirements, including Section
121.22 of the Ohio Revised Code.
SECTION 5: This Resolution shall take effect at the earliest period allowed by law.

MRS. WOLFF seconded the motion to adopt the Resolution. On the roll call
being called the vote resulted as follows:
