The Miami Township Board of Zoning Appeals met on Monday, December 6, 2007 to consider and set for public hearing an appeal of the Community Development Director's finding relating to Ohio Valley Voices, 6642
Branch Hill Guinea Pike.

The Miami Township Board of Zoning Appeals met on Monday, November 5, 2007 to consider and take action on the following cases: 

[Case 795]  R & K Partners.  The applicants, owners of Shooters Bar and Grill, requested a variance to permit an outdoor
                 dining patio.  The applicants argued the Ohio smoking ban prompted the request.  After a public hearing the 
                 Board voted to approve the variance request with conditions that primarily addressed potential noise problems.

[Case 796]  Harry Knapp.  The applicant requested a conditional use to permit the year round occupancy of a home 
                  located in the "H" Resort District.  Only seasonal occupancy to permitted by right.  Year round occupancy
                  is permitted is the applicant can address on-site septic issues and flood plain issues.  After finding the 
                  applicant met the conditions, the Board voted to approve the conditional use.

 

The Miami Township Board of Zoning Appeals met on Monday, October 1, 2007 to consider and take action on the following cases: 

[Case 793]  Teen Challenge.  The applicant requested a variance to permit a Women's Maternity Home on 3.25 acres in 
                  an Agricultural zoning District.  The minimum acreage required is 5-acres.  The home is proposed for a site 
                  US 50.  After a public hearing the Board voted to approve the variance.

[Case 794]  David Todd.  The applicant requested a rear yard setback variance for a proposed office building to be
                  constructed on Wards Corner Road.  The request was to reduce the setback from 35 feet to 8 feet.
                  The office project was part of a larger planned unit development that included retail and residential.
                  There is a conservation easement located behind the proposed office building.  Given the setback was 
                  internal to a planned development and no construction had started, the Board voted to approve the 
                  variance request.

 

The Miami Township Board of Zoning Appeals met on Monday, September 10, 2007 to consider and take action on the following cases: 

 

[Case 791]  The Villas at Tartan Glen. The applicant requested a Conditional Use to construct a Par 3, nine hole golf
                  course on land located between the existing condominium project and Mt Zion Road.  After a public hearing
                  the Board voted to approve the golf course because it met all the conditions listed in the Zoning Resolution
                  conditioned upon additional landscaping.
                 

[Case 792]   Civil and Environmental Consultants on behalf of Huntington Bank.  The applicant requested setback variances
                   for a proposed bank to be located on Loveland Miamiville Road because of grading problems on the site.  The
                   variances related to building setbacks and parking.   After a public hearing the Board voted to approve the
                   variances.
                                     

 

The Miami Township Board of Zoning Appeals met on Monday, August 6, 2007 to consider and take action on the following cases: 

[Case 787]   Michael & Terri Bennett. The applicant requested a variance to permit the keeping  of seven dogs on a 
                  platted subdivision lot.  The Zoning Resolution permits the keeping of three dogs on a platted subdivision lot.
                  After a public hearing the Board voted to deny the variance request.

[Case 788-789]   Mulberry Motors on behalf of Sonic Restaurant.  The applicant was requesting variances related to
                   signage and parking for a proposed Sonic Restaurant.  The variances related to the number of wall signs and
                   the size of parking stalls.  After a public hearing the Board voted to approve the variance request.
                   

[Case 786]   Hal Homes - Developer of Willows Bend Subdivision.  The applicant was requesting a setback and height
                   variance for a proposed subdivision entrance wall.  The applicant requested a five foot setback variance and 
                   three foot height variance.  After a public hearing the Board voted to approve the setback variance and modify
                   the height variance to a two foot variance permitting an eight foot high wall.                

 

 

The Miami Township Board of Zoning Appeals met on Monday, July 2, 2007 to consider and take action on the following cases: 

[Case 784]   Greg Orcutt.  This case was continued from the June 4 meeting. The applicant requested a side yard setback
                   variance to permit the construction of a building addition approximately 6 inches from the property line.   The
                   applicant met with the adjoining property owner and worked out issues relating to stormwater and  
                   landscaping.  The Board voted to approve a modified variance to permit the addition 1-foot from the property
                   line.                  

[Case 785]   MV Communities.   The applicant requested a a conditional use for a proposed assisted living facility to be
                   located at 5877 Wolfpen Pleasant Hill Road.  The facility will be three stories and will contain 120 units. 
                   After a public hearing the Board voted to approve the conditional use.

[Case 786]   Kurt Zobrist.  The applicant requested a rear yard setback variance to permit the construction of a covered
                   a patio approximately 17-feet from the property line.  
After a public hearing the Board voted to approve the
                   variance request.

The Miami Township Board of Zoning Appeals met on Monday, June 4, 2007 to consider and take action on the following cases: 

[Case 776]   Sharon Scovanner, 6586 Miami Trails Drive.  The applicant was appealing the approval of a revised site plan
                   by the Director of Community Development and appealing a legal opinion by the Township’s Law Director with
                   regards to Ohio Valley Voices School.  After a public hearing the Board voted to deny both the appeal of the
                   site plan and the appeal of the legal opinion.

[Case 782]   Milford Exempted Village School District.  The school district requested a conditional use for a proposed
                   outdoor classroom to be located on a lot on Werkshire Terrace. 
After a public hearing the Board found the
                   request did not meet the conditions set forth in the Zoning Resolution and voted to deny the conditional use.

[Case 783]   Extendicare.   The applicant requested a a conditional use for a proposed assisted living facility to be located
                   at 5897 Cook Road.  The facility will be two stories and will contain 60 units.  After a public hearing the Board
                   voted to approve the conditional use..

[Case 784]   Greg Orcutt.  The applicant requested a side yard setback variance to permit the construction of a building
                   addition approximately 6 inches from the property line.  
During the public hearing issues of stormwater and
                   landscaping were brought up before the Board.  The Board voted to continue the case until the July 2 meeting.

 

The Miami Township Board of Zoning Appeals met on Monday, May 7, 2007 to consider and take action on the following cases: 

[Case 776]   Sharon Scovanner, 6586 Miami Trails Drive.  The applicant was appealing the approval of a revised site plan
                   by the Director of Community Development and appealing a legal opinion by the Township’s Law Director with
                   regards to Ohio Valley Voices School.  The applicant presented her case and the Board took the case under
                   advisement until June 4, 2007.

[Case 780]   John Donohoo representing the owners of 5718 Hilltop Way.  The applicant requested a 16-foot setback
                   variance to permit the construction of a garage addition 34 feet from the right-of-way.  After a public hearing
                   the Board voted to approve the variance request conditioned upon the construction of an addition between the
                   house and the garage.

[Case 781]   Anne McBride representing Midland Atlantic, the developer of a proposed shopping center on SR 28 at
                   Buckwheat Road.  The applicant requested three variances - a reduction of the parking stall size from 10 x 20
                   feet to 9 x 19 feet; a reduction in the parking setback from 15 feet to 10 feet on the bank outlot and an
                   increase in the maximum number of parking spaces.  After a public hearing and a discussion on the parking
                   needs of the retail center, the Board voted to approve the three variance requests. 

[Case 782]   Milford Exempted Village School District.  The school district requested a conditional use for a proposed

                   continued the case until the June 4, 2007 meeting.

The Miami Township Board of Zoning Appeals met on Monday, April 2, 2007 to consider and take action on the following cases: 

[Case 776]  Sharon Scovanner, 6586 Miami Trails Drive.  The applicant was appealing the approval of a revised site plan by
                   the Director of Community Development and appealing a legal opinion by the Township’s Law Director with
                   regards to Ohio Valley Voices School.  At the request of the applicant this case was continued until May 7,
                   2007.

[Case 779]  Potterhill Homes, LLC, 100 TechneCenter Drive requested a variance to increase the maximum front yard
                  setback from 12 feet to 17 feet for the corner lot.  The turning radius on the corner created a hardship in 
                  moving the house closer to the street.  After a public hearing, the BZA agreed with the applicant's argument
                  and approved the variance request.

The Miami Township Board of Zoning Appeals met on Monday, March 5, 2007 to consider and take action on the following cases: 

[Case 776]  Sharon Scovanner, 6586 Miami Trails Drive.  The applicant was appealing the approval of a revised site plan by
                   the Director of Community Development and appealing a legal opinion by the Township’s Law Director with
                   regards to Ohio Valley Voices School.  At the request of the applicant this case was continued until April 2,
                   2007.

[Case 778]  Mr. Paul Friesz, 9560 Montgomery Road.  The applicant requested a variance to reduce the front yard
                  setbacks on 10 lots located in Weber Woods subdivision from 50 feet to 40 feet.  The subdivision is located 
                  on the north side of  Weber Road, approximately 400 feet west of Mitchell Farm Drive.   After a public hearing
                  the Board determined there was no hardship and voted to deny the variance request.

 

The Miami Township Board of Zoning Appeals met on Monday, February 5, 2007 to consider and take action on the following cases: 

 

[Case 772]  St Elizabeth Ann Seton  The applicant was requesting a 15 square foot Variance to permit a 47 square foot 
                  sign.  The proposal was to consolidate two signs into one sign.  After a Public Hearing the Board voted to 
                  approve the variance.

 

 [Case 775]  Kevin O’Leary, 5397 Sugar Camp Road. The applicant requested a variance for 300
                   additional square feet to permit a 1,200 square foot detached garage on a .92 acre site.  After a 
                   public hearing the Board voted to approve the variance request. 

[Case 776]  Sharon Scovanner, 6586 Miami Trails Drive.  The applicant was appealing the approval of a revised site plan by
                   the Director of Community Development and appealing a legal opinion by the Township’s Law Director with
                   regards to Ohio Valley Voices School.  At the request of the applicant this case was continued until March 5,
                   2007.

[Case 777]   Tim Gill, agent for Gerald L. Muennich, 840 Travis Ct. requested a variance of the rear yard setback to enclose
                   an existing deck.  After a public hearing the Board voted to approve the variance request.

 

The Miami Township Board of Zoning Appeals met on Monday, January 8, 2007 to consider and take action on the following cases: 

 

[Case 769]  St Elizabeth Ann Seton  The applicant was requesting a 15 square foot Variance to permit a 47 square foot 
                  sign.  The proposal was to consolidate two signs into one sign.  Due to a conflict of interest issue this 
                  case was continued until February 5, 2007.
                  

[Case 770]  Bronze Stone Cemetery.  The applicant was requesting a 65 foot variance from the 200 foot rear yard setback 
                  for a mausoleum.  After a public hearing the Board voted to approve the variance request.                  

 

[Case 771]  S& S Development  The applicant was requesting a 30 square foot variance and a 13 foot
                  height variance for a proposed retail center sign.   The applicant proposed to consolidate 4 
                  signs into one sign.  After a public hearing the Board voted to approve the variance request.
